Warren's Private-Listings Rebuke Should Change How You Document
Senator Elizabeth Warren publicly called out the MRED–Compass partnership this week, joining a growing group of lawmakers questioning how "coming soon" and private listings affect consumer access.
One senator's press release doesn't change your MLS rules. The direction of travel is what matters, and the direction is: more scrutiny, not less.
Why this matters
- This is the second wave of federal pressure on private listing networks this year, not a one-off.
- Plausible outcomes include tighter MLS regulations or fair-market-access investigations. Either lands on daily practice.
- If private or "coming soon" strategies are part of your business, the time to document your reasoning is before anyone asks.
The call: HEADS-UP
Nothing dramatic to buy or cancel. But if you use off-market strategies, write down the client-interest rationale for each one today, while it's easy: why this seller, why this strategy, what they were told, what they signed. Agents who documented as they went will be fine. The ones reconstructing files after the fact won't enjoy it.
- List your active or recent off-market/“coming soon” listings.
- For each, write two sentences: the client's reason, and what the seller signed acknowledging the tradeoffs.
- Save it in the transaction file, not a sticky note.
